Criminal Aspects of Corruption This diploma thesis focuses on corruption as a negative social phenomenon which is as old as humanity itself, especially, through the viewpoint of criminal law as a means for ultima ratio. It analyses substantive and processional law aspects of corruption in legal regulations of the Czech Republic as well as in international regulations. This thesis concerns itself with criminal acts of bribery and means used to uncover, investigate, and prove corruptive practices. The introduction of this thesis concentrates on the explanation of its key term "corruption" and terms that directly or indirectly fall under the concept of corruption, as well as the reasons why corruption occurs, its development stages and the structure of corruption, including manners of corruptive behaviour. In the second chapter of this thesis the author looks at corruption from a historical viewpoint by means of an excursion into the global history of this phenomenon. Especially concentrating on the first references to corruption and legal regulations in place on the Czech territory since 1707 up to the Velvet Revolution. The Fight against Corruption in Prague - the Anti-corruption Strategy of Government and Civil Society during the "Necas's government".

Presented work deals with the issue of fighting against corruption. In a theoretical level the work informs about the causes of corruption and the tools that are currently used for its persecuting. In the practical part I try to find out the way of improvement of corruption range seen throgh the eyes of actors that operate in Prague city. The aim of the work is to identify possibilities of efficiency improvement of nonprofit organizations and the public sector in the field of fighting against the corruption. The analytical part of the work, therefore, maps the situation in relations between selected non-profit organizations and relations between them and the public administration, which is in this work represented by the Prague City Hall - an institution which represents by the local government activities.

Title Corruption. English Abstract The rigorous work deals with the evaluation of the level of criminal substantive law and criminal procedural law with the greatest emphasis on the national level. The primary goal of this work is to find out how it is currently possible to face the corruption and whether the Czech legislation provides useful tools to help fight against the corruption. As the necessary prerequisite for the fight against the corruption is the prevention of the corruption, the detection of corruption practices and the need to punish enough the corruption, this rigorous work divides instruments of the fight against the corruption into three groups, first group is preventive instruments, second group is instruments of detection and third group is instruments of sanctions. The rigorous work deals with all of these groups of instruments when attention is paid both in general and also specifically on Czech criminal law. In order to assess the effectiveness of all instruments, the first criterion is a sufficient scale, which means whether the Czech legislation can punish all types of corruption, the second criterion is the ability to search for, secure and make available sufficient evidence, and the third criterion is the stringency of punishments. Corruption is a very current problem, which occurring in both the public and private sectors, poses a great threat to society as a whole. The main goal of the diploma thesis is to provide a thorough analysis of the legal regulation of corruption in the Czech republic. Therefore, this work presents both substantive law, with focus on criminal offenses of bribery, and procedural law. The introductory section of the thesis introduces the theoretical aspects of corruption; namely the definition of this term as well as other related terms, types of corruption or the possibilities of measuring it. The author does not omit the relevant European and international aspects of the fight against corruption. The main part of the thesis is devoted to the Czech legislation currently in force related to bribery; but it deals with the development of legislation in the Czech Republic, too. Thus, the work discusses criminal offenses of bribery; corruption sanctions regime, as well as procedural tools focused on uncovering corrupt conduct. The final part of the work focuses on the comparison of legislation in the Slovak republic and French Republic. Corruption in the Customs Administration of the CR

Thesis "Corruption in the Czech Customs Administration" is focused on the issue of corruption and the causes of corrupt behaviour of Czech customs officials. The primary task of this work was to determine whether it is the disorganization of the armed force or the individual deviance which influences the level of corruption in the Czech Customs Administration more. The secondary task was to elicit the level of corruption as it is perceived by the customs officials themselves and on the basis of the acquired information to suggest some anti-corruption measures. The theory of social disorganization and the theory of social deviancy were used as the basis for this work. The data required for the decision whether it is the disorganization of the armed force or the individual deviance which influences the level of corruption in the Czech Customs Administration more and the data for the findings of the corruption level as it is perceived by the customs officials was collected from a quantitative research. Legal regulation and combating corruption in Spain

This bachelor thesis deals with corruption in Spain. The aim of this work is to explain the position of corruption primarily in the area of legislation and its combat. It also highlights the dangers of this phenomenon and the necessity for its elimination from the society. The first chapter discusses the definition and legal sources of corruption. The second chapter is about fight against corruption through international and European organizations. Court ruling about particular case of bribery is set in the third chapter. Final chapter analyzes the results of the questionnaire survey.
OLAF vs. GRECO - Fight against corruption in Europe

The thesis deals with the problematic around the fight against corruption in Europe. Specifically it focuses on two organizations: OLAF and GRECO. The aim of this thesis is to determine how intensively these two organizations have contributed in the fight against corruption in Europe. Historical description, analysis of institutional settings and comparative analysis were used as methods for the solution. The sub-questions, which focused on the organizational structure, the opportunity to influence the investigation, the possibility of setting up anti-corruption policies in Europe and the opportunity to influence the legislation in its Member States, helped to answer the main question. Carrying out this comparison, it was found that although OLAF can conduct its own investigation of financial fraud, it has not got the ability to set up anti-corruption policies in Europe, neither has it got the possibility to influence the legislation in its Member States. In contrast, GRECO does not investigate financial fraud, but it may, to some degree, have influence on setting up the anti-corruption policies in Europe. GRECO also has the power to influence the legislation of its Member States. The conclusion of this work delivers a report on the status and capability to fight against corruption in Europe (from an EU and European Council perspective). It also provides material about the work of OLAF and GRECO in the Czech language.
Corruption in Slovakia: The role of non-government organizations in fight against corruption

Corruption as a contemporary phenomenon attracts attention of laymen but also experts who are trying to define this notion on the basis of various criterions. The aim of this thesis is to theoretically define corruption as the attendant phenomenon of the current society and to analyze methods of its solution. The studied country is Slovak republic which as a post-communist country shows some specifics. There are many proposed ways how to solve the problem of corruption however this thesis concerns itself primarily with the role of non-government organizations and their ability to actually influence political acts concerned with restricting of corruption possibilities. The intense cooperation among these non-government organizations and especially their cooperation with the government is crucial in order to be able to influence the political agenda. Therefore this thesis deals with this non-government organizations -- government relationship as well.
